PSL MP: Political benefits are more important to the authorities today than the situation in five years
The presidential bill on the Supreme Court was passed and it comes into force on 15 July. Are we dealing with a significant change in the administration of justice?
Despite my best efforts, I am not able to show many differences between the old Disciplinary Chamber of the Supreme Court and the newly established body, i.e. the Chamber of Professional Responsibility. The President's Act replaces one flawed institution with another flawed institution. The Chamber of Professional Responsibility still has many elements that indicate that judges in Poland will not be independent. It will still be possible to discipline them politically and influence their work.
What will the system of appointing judges look like now, after the liquidation of the Disciplinary Chamber?
The first president of the Supreme Court will select people who make up the Disciplinary Chamber of the Supreme Court today, and if they wish to continue working, they will receive a transfer proposal and will be transferred to individual chambers of the Supreme Court. We protested against this procedure.
Failure to submit a declaration of will or departure of these judges from the Supreme Court will cause them to retire.
Do you have information on how many judges will make a declaration of will about further adjudication, and how many will want to leave?
I have very different information, some say that many of these judges will remain in office. New 33 judges will be selected at random, who will be presented to the President for his election and included in the new professional accountability commission.
How many judges will the president choose? How will Andrzej Duda behave towards these two types of judges in the Supreme Court?
There are so-called new judges who were appointed by the new, defective NCJ. But there are also judges who were elected in the days before the changes made by PiS in the judiciary. This will be another test for the president, we will see how he behaves.
